Depending on the type of benefits that you wish to apply for, you may need to provide proof of military service, such as a DD-214 Form. You may also need to provide other documents, such as your marriage and birth certificate.

Veterans can appeal decisions that they believe are incorrect or that they disagree with. Veterans can file a Notice of Disagreement (NOD) with their local VA Regional Office (VARO). 

If a veteran is not satisfied with the decision of the VARO, then they can file a Request for Higher Level Review (RHLR) to the Board of Veterans' Appeals (BVA). 

The BVA is an independent agency within the Department of Veterans Affairs. It is responsible for reviewing decisions made by VAROs on a variety of benefits claims. The BVA can uphold or overturn decisions made by the VARO.

If a veteran is still not satisfied with the decision of the BVA, they can file an appeal with the United States Court of Appeals for Veterans Claims (CAVC). The CAVC is the final level of appeal for veterans’ benefits decisions.

The appeals process can be long and complicated. It is important for veterans to understand their rights and options throughout the process. There are a variety of resources available to help veterans with their appeals.

Here are the general steps you need to take when you are looking to appeal your veterans benefits claim: 

  1. Gather all the information and documents you need to support your claim. This will include your DD-214, medical records, and any other evidence that supports your appeal.

  2. Fill out the appropriate forms. The forms you will need to complete will depend on the type of benefit you are appealing.

  3. Submit your completed appeal forms and all supporting documentation to the VA office that handles appeals.

  4. Wait for a decision. The VA will review your claim and make a decision.

  5. If you disagree with the decision, you can appeal the decision to the Board of Veterans Appeals.

  6. If you still disagree with the decision, you can appeal to the Court of Appeals for Veterans Claims.

  7. If you are unsuccessful at all levels of appeal, you can file a Writ of Certiorari with the U.S. Supreme Court.
